The agreement between you and Enacvale when you use the site and the Studio.

About these terms

These terms are between you and Individual Entrepreneur Miriani Chkhvimiani, identification number 15001025936 - “Enacvale”, “we”. By creating an account you agree to them, to the Refund and Cancellation Policy and to the Privacy Policy.

The service

Enacvale dubs video into another language, turns text into speech, and lets you correct a finished dub. Results are produced by automated systems and can contain mistakes; check them before you publish.

The service is digital and starts immediately after a purchase: a plan or extra usage can be used the moment the payment is confirmed.

We may change, add or remove features of the service. If a change takes away something you have already paid for, you will be notified before it takes effect.

Your account

  • You must be at least 18 years old to create an account or pay.
  • You confirm your email address before you can run anything or pay.
  • You keep your sign-in details private and are responsible for what happens under your account.

Plans and usage limits

A plan is a monthly usage limit at a monthly price. Each run shows how much of the limit it will use before it starts, and a run that does not fit is refused before anything is used.

  • Your month resets on the day of the month you subscribed. Unused usage does not carry over.
  • A subscription renews automatically each month and is charged to the card you paid with, until you cancel.
  • Upgrading starts the new plan immediately and is paid in full; what is left of the previous plan stays until its own end. Downgrading takes effect when the current month ends.
  • If a renewal payment fails, the plan's usage pauses and we try the card again daily for seven days; after that the plan ends.
  • Each plan keeps your projects available for its own storage period. After that period a project is no longer available in your account.

Free usage and extra usage

A confirmed account receives a one-time free usage allowance for trying the service. It ends when you buy a plan. Subscribers can buy extra usage - a share of their plan's monthly limit at the plan's own rate - which does not expire while the account exists and is used after the month's own usage.

Usage has no cash value

Usage - from a plan, the free allowance or extra usage - can only be used for Enacvale's service. It cannot be transferred to another person or account, sold, exchanged, converted into money or withdrawn. It is not money, electronic money or a virtual asset. When an account is closed, the usage left on it ends with it.

Prices and payment

Prices are in Georgian lari and are shown on the pricing page. Payments are processed by our payment provider; we never see or store your card number. If a price changes, the new price applies from your next renewal, and you will be notified before it does.

Purchases are not refunded, except where the law requires otherwise. Cancellation, and the one case in which money is returned, are described in the Refund and Cancellation Policy.

Your content

What you upload and what the service makes from it are yours. You allow us to store and process them to provide the service to you, and to use them to improve our service and to train our models - including after a project is no longer available in your account. You confirm that you have the rights to what you upload, including the voices in it, and that you may grant us this permission.

You can ask us not to use your content to train our models by writing to contact@enacvale.com, as the Privacy Policy describes.

Acceptable use

  • Do not copy or imitate a person's voice without their permission. If what you upload contains someone else's voice, you must have their consent for it to be copied, translated and spoken again.
  • Do not present synthetic speech as a real person's words to mislead anyone, impersonate anyone, or use the service for fraud or scams.
  • Do not make sexual content using a real person's voice or likeness without their consent, or any content that sexualises, exploits or endangers children.
  • Do not make content that harasses, threatens or defames anyone, or incites hatred or violence.
  • Do not make disinformation meant to mislead the public, including about elections, public figures or emergencies.
  • Do not upload unlawful content, or content you have no right to use.
  • Do not use the service to send spam or unsolicited advertising.
  • Do not copy, decompile or reverse-engineer the service, scrape it or reach it by automated means we do not provide, resell or share access to it, or use it to build a competing product.
  • Do not try to break, overload or get around the limits or security of the service.

Our rights in the service

The service - its software, models, catalogue voices, design and name - belongs to Enacvale and its licensors. These terms give you a personal, non-transferable right to use it as they describe, and no other right in it. What you make with it remains yours, as described above.

If you send us ideas or suggestions, we may use them freely, without any obligation to you.

Reporting misuse

If you believe something made with Enacvale uses your voice, your likeness or your work without permission, or breaks these rules in another way, write to contact@enacvale.com and tell us what it is, where it is and why. We review every report and take appropriate action, which can include removing content, suspending or closing the account responsible and, where the law requires it or someone is at risk, informing the authorities.

Suspending and closing an account

We may suspend or close an account, and remove content from it, if it breaks these terms, if the law requires it, or to protect other people or the service. Where it is reasonable, we will tell you why. Usage on an account closed for breaking these terms is not refunded.

You can close your account at any time by writing to contact@enacvale.com. The sections on your content, indemnity, liability and governing law continue to apply after an account is closed.

Indemnity

You agree to defend, indemnify and hold harmless Enacvale, its owners, employees and contractors against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or relating to your content, your use of the service, or your breach of these terms or of anyone's rights - including rights in a person's voice, likeness or work.

Liability

The service is provided as it is and as available. Its results are produced by AI and can contain mistakes: a translation can be wrong, and a voice can sound unlike the original or resemble someone else's. We do not promise that the service will be uninterrupted or free of errors, or that a result will suit your purpose. You are responsible for checking a result before you publish or rely on it.

As far as the law allows, we are not liable for indirect or consequential losses - including lost income, profit, audience or reputation, or action taken against you by a platform you publish on - and our total liability to you is limited to what you paid us in the month before the claim. Nothing in these terms limits liability that the law does not allow to be limited.

General

  • We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of the providers the service depends on, power or network failures, or actions of the authorities.
  • If part of these terms is found invalid, the rest remains in effect. Not enforcing a part of them straight away does not mean we have given it up.
  • These terms, the Refund and Cancellation Policy and the Privacy Policy are the whole agreement between you and us about the service. You may not transfer your account or these terms to anyone else; we may transfer them to whoever takes over our business.
  • The site links to other sites and shows videos hosted elsewhere, such as on YouTube. We are not responsible for their content or their policies.

Changes and governing law

We may update these terms, and you will be notified before a change that affects you takes effect. These terms are governed by the law of Georgia, and disputes are decided by the courts of Tbilisi.
